Systems D Computer Repair Services

Important: By using our website and services, you acknowledge that you have read, understood, and agree to be bound by these terms of service. Please read carefully before proceeding.
1. Services Overview
Systems D provides residential and small business computer repair, maintenance, and technical support services including but not limited to:
- Hardware diagnosis, repair, and replacement
- Software installation, configuration, and troubleshooting
- Operating system installation and optimization
- Data recovery and backup services
- Virus and malware removal
- Network setup and configuration
- Computer tune-ups and maintenance
- On-site and remote technical support
2. Service Commitment and Limitations
Best-Effort Basis: All services are provided on a best-effort basis. While we strive to resolve all technical issues, we cannot guarantee that every problem can be fixed or that all desired outcomes can be achieved.
No Warranty on Results: We do not warrant that our services will meet your specific requirements or that the operation of any repaired device will be uninterrupted or error-free.
3. Data and Backup Responsibility
CRITICAL WARNING: You are solely responsible for backing up all data, files, software, and system configurations before any service begins. Computer repair and troubleshooting may result in data loss, even when not anticipated.
- Backup Requirement: You must create complete backups of all important data before service
- Data Recovery: While we offer data recovery services, success is not guaranteed
- No Data Liability: We are not responsible for any data loss, corruption, or unauthorized access
- Data Confidentiality: We will maintain confidentiality but cannot guarantee absolute security
4. Equipment Handling and Care
We will exercise reasonable care in handling your equipment, however:
- Pre-existing hardware defects may become apparent during diagnosis
- Aging components may fail during or after service
- Software conflicts may arise from repairs or installations
- Equipment may require factory reset or system reinstallation
5. Pricing and Payment Terms
Service Rates
- Diagnostic fees are charged regardless of repair outcome
- Hourly rates are provided at time of service estimate
- Minimum service charges may apply
- Travel time for on-site service is billable
Parts and Software
- Replacement parts are billed at cost plus handling fee
- Software licenses are billed separately
- Parts warranty is limited to manufacturer warranty terms
- No warranty on used or refurbished parts unless specified
Payment
- Payment is due upon completion of service
- We accept cash, check, and major credit cards
- Equipment may be held until payment is received
- Returned checks incur additional fees
6. Limitation of Liability
IMPORTANT LIABILITY LIMITATIONS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM.
We specifically disclaim liability for:
- Data loss, corruption, or unauthorized access
- Business interruption or lost profits
- Consequential, incidental, or indirect damages
- Damage to equipment not directly caused by our negligence
- Software malfunctions or compatibility issues
- Third-party software or hardware failures
- Internet connectivity or network issues
- Security breaches or cyber attacks
7. Customer Responsibilities
You agree to:
- Provide accurate information about the problem and equipment
- Back up all important data before service
- Remove or secure confidential information
- Provide necessary passwords and access credentials
- Be present for on-site service appointments
- Pay for services promptly upon completion
- Notify us immediately of any post-service issues
8. Equipment Pickup and Abandonment
- Equipment must be picked up within 30 days of service completion
- Storage fees may apply after 30 days
- Equipment not retrieved within 90 days may be considered abandoned
- Abandoned equipment may be disposed of or sold to recover costs
- You remain responsible for all outstanding charges
9. Warranty and Service Guarantee
Service Warranty
- 30-day warranty on labor for hardware repairs
- 90-day warranty on parts we install (subject to manufacturer warranty)
- No warranty on data recovery, virus removal, or software issues
- Warranty void if equipment is serviced elsewhere or damaged by customer
Warranty Limitations
- Warranty covers only the specific issue addressed
- New or unrelated problems are not covered
- Software conflicts and compatibility issues excluded
- Normal wear and tear excluded
10. Intellectual Property and Software
- Customer must own or have valid licenses for all software
- We do not provide or install pirated software
- We may refuse service if software appears unlicensed
- Customer responsible for software licensing compliance
11. Privacy and Confidentiality
We respect your privacy and will make reasonable efforts to protect confidential information. However, you should remove sensitive data before service. See our Privacy Policy for details.
12. Cancellation and Refunds
- Service appointments may be cancelled with 24-hour notice
- Diagnostic fees are non-refundable once work begins
- Refunds considered only for unused services or defective parts
- Travel charges apply for cancelled on-site appointments
13. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through binding arbitration under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits against us.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of unlicensed software, violation of these terms, or misrepresentation of equipment ownership.
15. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, or technology failures.
16. Severability and Governing Law
If any provision of these terms is found unenforceable, the remaining provisions remain in effect. These terms are governed by [Your State] law, excluding conflict of law principles.
